House Clearance Docklands Terms and Conditions

These Terms and Conditions govern the provision of house clearance and waste collection services by House Clearance Docklands to residential and commercial customers in the United Kingdom. By booking or using our services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following definitions apply:

1.1 Service means any house clearance, rubbish removal, waste collection, bulky item removal, or related services provided by House Clearance Docklands.

1.2 Customer means the person, company, or organisation booking or receiving the Service.

1.3 Property means the address or premises where the Service is to be carried out.

1.4 Waste means any items, materials, furniture, appliances, or other goods agreed to be removed as part of the Service, excluding any prohibited items as set out in these Terms and Conditions.

1.5 Agreement means the contract between the Customer and House Clearance Docklands incorporating these Terms and Conditions and any written or verbal quotation or confirmation provided.

2. Scope of Services

2.1 House Clearance Docklands provides house and flat clearances, part-clearances, office and commercial clearances, garden waste removal, and general waste collection services, subject to availability and any applicable legal or regulatory requirements.

2.2 The Service generally includes loading of Waste from the Property, transportation, and lawful disposal or recycling at an authorised facility.

2.3 The exact scope of the Service, including the volume and type of Waste to be collected, any access limitations, and any additional work required, will be agreed at the time of booking or at the time of on-site assessment.

2.4 House Clearance Docklands reserves the right to refuse the collection of any items that are hazardous, prohibited by law, unsafe to handle, or not agreed at the time of booking or on-site assessment.

3. Booking Process

3.1 Bookings can be made by telephone, email, or other communication methods offered by House Clearance Docklands from time to time.

3.2 When making a booking, the Customer must provide accurate and complete information, including but not limited to the Property address, access details, type and approximate volume of Waste, parking arrangements, and any known hazards.

3.3 Any quotation given prior to an on-site assessment is based on the information provided by the Customer and is an estimate only. Final pricing may be confirmed upon arrival at the Property and inspection of the Waste.

3.4 A booking is not confirmed until accepted by House Clearance Docklands, which may be communicated in writing or verbally. We reserve the right to decline any booking at our discretion.

3.5 The Customer must ensure that a responsible adult is present at the Property at the agreed time to grant access, confirm the items to be removed, and authorise any variations to the Service.

4. Access and Parking

4.1 The Customer is responsible for ensuring safe and reasonable access to the Property and the Waste to be collected. This includes arranging any parking permits or permissions necessary for our vehicles.

4.2 If suitable parking is not available, or access is restricted or unsafe, House Clearance Docklands may charge additional waiting time, parking costs, or reasonable extra labour charges. In some cases, we may be unable to complete the Service, in which case a call-out or cancellation fee may apply.

4.3 The Customer must inform us in advance of any known access issues, such as narrow staircases, restricted height, security gates, or health and safety risks, so that suitable arrangements can be made.

5. Customer Obligations

5.1 The Customer agrees to:

a. Provide accurate information when booking and during the Service.

b. Ensure access to the Property at the agreed time.

c. Secure any necessary permissions, consents, or permits from landlords, building managers, neighbours, or local authorities.

d. Separate, as far as reasonably possible, any items that are not to be removed.

e. Comply with all applicable laws and regulations in relation to the Waste and the Property.

5.2 The Customer warrants that they have either ownership of the Waste or full authority from the owner to arrange for its removal and disposal.

6. Pricing and Quotations

6.1 Prices are typically based on the volume, weight, and nature of the Waste, as well as the time, labour, and any additional services required.

6.2 Quotations provided in advance are estimates and may be revised if:

a. The information supplied by the Customer is inaccurate or incomplete.

b. The Waste volume or type differs from what was described.

c. Additional labour, time, or resources are required due to access issues or other unforeseen circumstances.

6.3 Any revised price will be explained to the Customer before work proceeds. If the Customer does not accept the revised price, House Clearance Docklands reserves the right to cancel the Service and may charge a call-out fee or reasonable costs already incurred.

7. Payments and Invoicing

7.1 Payment terms will be confirmed at the time of booking. Unless otherwise agreed in writing, payment is due in full upon completion of the Service.

7.2 We may accept payment by cash, debit card, credit card, bank transfer, or other methods notified to the Customer. The Customer is responsible for ensuring that cleared funds are available.

7.3 For commercial Customers or account holders, invoicing and payment terms may be agreed separately. Late payment may incur interest and administrative charges in accordance with applicable UK law.

7.4 House Clearance Docklands reserves the right to withhold or discontinue the Service if payment is not made in accordance with these Terms and Conditions.

8. Cancellations and Changes

8.1 The Customer may cancel or re-schedule a booking by providing reasonable notice to House Clearance Docklands.

8.2 If a booking is cancelled by the Customer with less than 24 hours notice before the scheduled arrival time, House Clearance Docklands may charge a cancellation fee to cover costs incurred.

8.3 If our team attends the Property and is unable to carry out the Service due to lack of access, absence of an authorised person, or other reasons beyond our control, we may charge a call-out fee or a percentage of the quoted amount.

8.4 House Clearance Docklands reserves the right to cancel or re-schedule a booking due to circumstances beyond our reasonable control, including severe weather, traffic delays, vehicle breakdown, staff illness, or safety concerns. In such cases, we will endeavour to re-schedule as soon as reasonably possible and no cancellation fee will apply.

9. Waste Types and Prohibited Items

9.1 House Clearance Docklands operates in accordance with UK waste management regulations and environmental legislation.

9.2 We do not normally collect hazardous or specialist waste, including but not limited to asbestos, clinical or medical waste, chemical or toxic substances, gas cylinders, paint cans containing liquid, fuel or oil, explosives, or any items classified as hazardous under applicable regulations.

9.3 Electrical and electronic equipment, refrigeration units, batteries, and similar items may be subject to additional charges or specific handling requirements. The Customer must inform us in advance if such items are to be collected.

9.4 If prohibited or hazardous items are discovered among the Waste, we may refuse to remove them, adjust the price, or suspend the Service. Any costs incurred for safe handling, storage, or return of such items may be charged to the Customer.

10. Title to Waste and Recycling

10.1 Once Waste has been removed from the Property and loaded onto our vehicle, legal title to that Waste passes to House Clearance Docklands, subject to compliance with all applicable laws.

10.2 We aim to minimise the volume of Waste sent to landfill by recycling and re-using items where possible and by using licensed waste transfer and disposal facilities.

10.3 The Customer acknowledges that salvage, re-use, or sale of certain items by House Clearance Docklands forms part of our recycling and sustainability objectives and does not entitle the Customer to any additional payment unless expressly agreed in writing before the Service.

11. Liability and Insurance

11.1 House Clearance Docklands will exercise reasonable care and skill when providing the Service. However, we shall not be liable for:

a. Pre-existing damage, defect, or wear and tear to the Property or any items within it.

b. Damage arising from inadequate or unsafe access, including narrow stairways, unstable flooring, or poorly maintained structures.

c. Loss of or damage to any item that the Customer intended to keep but did not clearly separate or identify from the Waste.

11.2 The Customer is responsible for checking the Property and confirming which items are to be removed before the Service starts. Once items have been loaded and removed, it may not be possible to retrieve them.

11.3 Our liability for any loss or damage arising out of or in connection with the Service, whether in contract, tort, or otherwise, shall be limited to the total fees paid or payable by the Customer for the specific Service giving rise to the claim.

11.4 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under UK law.

11.5 House Clearance Docklands maintains appropriate insurance cover for public liability and, where applicable, employers liability, in accordance with UK law.

12. Damage and Complaints

12.1 Any alleged damage or issue arising from the Service must be reported to House Clearance Docklands as soon as reasonably practicable and, in any event, within 48 hours of completion of the Service, supported by photographs and a written description where possible.

12.2 We will investigate any complaint and may request access to the Property to inspect the alleged damage. The Customer must cooperate fully with any such investigation.

12.3 Where we are found to be responsible for damage, we may, at our discretion, arrange repair, offer reasonable compensation, or otherwise seek to resolve the issue in a fair and proportionate manner.

13. Customer Data and Confidentiality

13.1 House Clearance Docklands will collect and process personal information provided by the Customer for the purpose of managing bookings, delivering the Service, processing payments, and fulfilling legal obligations.

13.2 We will take reasonable steps to keep personal information secure and will not sell or disclose it to third parties except where necessary to provide the Service, comply with law, or enforce our rights.

14. Health and Safety

14.1 House Clearance Docklands is committed to operating in a safe and responsible manner. Our team members must follow health and safety procedures at all times.

14.2 If our team considers that any situation at the Property presents a risk to health or safety, we may suspend or cancel the Service, or require additional measures to be taken before proceeding.

14.3 The Customer must inform us of any known hazards at the Property, including structural issues, contamination, sharps, or dangerous materials.

15. Force Majeure

15.1 House Clearance Docklands shall not be liable for any delay or failure to perform any obligation under these Terms and Conditions where such delay or failure is caused by events beyond our reasonable control, including but not limited to extreme weather, natural disasters, accidents, acts of terrorism, war, labour disputes, or disruption of transport or utilities.

16. Variations to Terms

16.1 House Clearance Docklands may update or amend these Terms and Conditions from time to time. The version in force at the time of the Customer's booking will apply to that Service.

16.2 Any variation to these Terms and Conditions requested by the Customer must be agreed in writing by House Clearance Docklands.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with the Service shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service, without prejudice to any mandatory rights the Customer may have under consumer protection legislation.

18. Severability

18.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, illegal, or unenforceable, that provision shall be removed or limited to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

19. Entire Agreement

19.1 These Terms and Conditions, together with any quotation, booking confirmation, or other agreed documents, constitute the entire agreement between the Customer and House Clearance Docklands in relation to the Service and supersede any prior understandings or representations, whether written or oral.

19.2 The Customer acknowledges that they have not relied on any statement, promise, or representation that is not set out in these Terms and Conditions.
